On April 9, 2021, President Biden submitted his fiscal year 2022 discretionary funding request to the Senate Committee on Appropriations. The discretionary request includes $11.4 billion for the Department of Commerce, which is a $2.5 billion or 28% increase over the 2021 enacted level. In a nod towards BIS, the Administration notes that the “request ensures Commerce has additional staff and resources to analyze export control and Entity List proposals, enforce related actions, and implement executive actions related to export controls and secure telecommunications.” This indicates not only the Administration’s desire to ensure BIS has adequate funding for enforcement actions, but also demonstrates the U.S. Government’s continued focus on the exports of sensitive telecommunications technology. The request did not specify how much of the funding boost would be directed to BIS, but this will likely be set forth in documents submitted to Congress as part of the budget-making process.
