Rachael has a diverse healthcare practice representing institutional and individual clients in transactions, administrative proceedings and litigation as well as counseling on operational and regulatory issues. A majority of Rachael’s time is focused on counseling clients concerning regulatory compliance with state insurance and other health related laws. Rachael serves on the President’s Council of the Seton Fund. As part of the leadership for Seton’s Future of Care Campaign, Rachael represents those dedicated to Seton’s mission and the success of Dell Seton Medical Center at The University of Texas.

  • Representing clients in investigations, contested matters, administrative appeals and due process hearings before various state agencies, including the Texas Health and Human Services Commission, Texas Department of Insurance, Texas State Board of Pharmacy, Texas Board of Nursing and Texas Medical Board, and the Texas Workforce Commission.
  • Assisting clients with obtaining certificates of authority from the Texas Department of Insurance to operate as health maintenance organizations, third-party administrators and utilization review agents.
  • Advising clients regarding issues relating to Medicaid, Medicare and other state and federal healthcare programs, such as Medicare certification, change of ownership and Medicaid enrollment.
  • Negotiating and reviewing provider payor, employment, medical director and coverage agreements.
  • Evaluating and analyzing compliance with anti-fraud and abuse statutes and regulations on both state and federal levels (including the Stark Law).
  • Assisting clients involved in government contracting with protecting their confidential and proprietary information from public disclosure through open records requests made under  the  Texas Public Information Act.
  • Defending health plans against provider claims for payment.
  • Defending a managed care organization in arbitration brought by a Medicare Risk Adjustment vendor.
  • Representing a health plan in litigation against claims of tortious interference with business relationships and misappropriation of trade secrets.
