Jo Ann Merica represents plaintiffs and defendants in a broad-based civil litigation practice, including real estate, construction, commercial, consumer, family and administrative law disputes.  She has successfully brought and defended claims involving breach of contract, deceptive trade practices, fraud, construction defects, Fair Labor Standards Act (FLSA) violations, condemnation, and restrictive covenants.

Jo Ann has taught Trial Advocacy as an adjunct professor at the University of Texas School of Law since 1993.  She has been selected to the Texas Super Lawyers List, a Thompson Reuters service, from 2009 to 2015.

Jo Ann's legal career also reflects a commitment to professional leadership and community service.  She serves as chair of Texas Lawyers for Texas Veterans, a State Bar program that has established pro bono advice clinics around the state to serve Texas veterans.  Each bar association led by Jo Ann has won first-place honors and awards for projects created and implemented during her leadership, including the "And Justice for All" specialty license plate created by the Texas Young Lawyers Association, which has raised more than $250,000 for legal services to the poor in civil matters.

Jo Ann is an active trial and appellate lawyer and has litigated numerous cases, administrative hearings, and NASD and construction related arbitrations, including:

  • Successfully defending a locally owned business against a claim brought under the Fair Labor Standards Act in a federal jury trial
  • Obtaining a favorable jury verdict recovering damages and attorney's fees in a deceptive trade practices case arising from the purchase of a restored classic car (and obtaining its affirmance on appeal)
  • Successfully defending in a jury trial the general contractor of a condominium project in a breach of contract action
  • Obtaining a judgment for title to disputed waterfront property
  • Obtaining a motion for summary judgment in favor of a real estate developer to remove restrictive covenants from commercial property
  • Obtaining a favorable decision in an NASD arbitration in an action between two brokers concerning a compensation agreement
  • Successfully defending a challenge to the action of an administrative agency in terminating its Deputy General Counsel
  • Obtaining reversals upon judicial review of four separate decisions of  the Texas Commission on Environmental Quality and the Texas Health Commission
  • Representation of a high net worth client in divorce proceedings involving a challenge to transactions in the family trust
  • Obtaining a judgment on behalf of a  law firm for unpaid fees
  • Representation of local homebuilding companies in matters alleging construction defects and warranty claims
  • Representation of same sex partners in real and personal property disputes
  • Obtaining the dismissal of a case through sanctions imposed against plaintiffs and their counsel
  • Successful appeal and reversal of a district court judgment denying personal jurisdiction over Respondent in Texas
