Jessica Palvino represents clients in state and federal courts throughout the United States. She has a broad practice with a focus on products liability, personal injury, legal malpractice defense, and business disputes.  She also co-spearheads McGinnis Lochridge's Unmanned Aircraft Systems (UAS/drone) practice. She is active in the drone/UAS community, participating in upcoming panels and podcasts.  An entrepreneur at heart, Jessica is a board member of the Austin-based Thinkery, which she describes as "a foundry for a new generation of innovators and problem solvers."  As the daughter of a veterinarian/cattle rancher dad and hay farm owner mother, Jessica grew up as the president of her future farmers of America club and has a particular interest in the use of drones for precision agriculture/ranching.  More information about the practice can be found at

Jessica received the Outstanding Young Lawyer Award from the Austin Bar Foundation and the Austin Bar Association (2015) and has been selected to the Texas Super Lawyers Rising Stars list, a Thomson Reuters service, (2014-2016) and has been featured as one of six Texas attorneys in the Super Lawyer's Magazine Rising Stars 2016 edition.  Jessica is an integral member of the McGinnis Lochridge Products Liability Group which was named the 2015 Product Liability Litigation Department of the Year by Texas Lawyer and was appointed to the Texas State Bar’s Pattern Jury Charge Committee for Malpractice, Premises & Products Liability.

Personal Injury & Wrongful Death

  • Assisting in obtaining a jury verdict on behalf of a child who was severely injured by Botox® injections in federal court in Burlington, Vermont (November 2014).
  • Assisting in obtaining a jury verdict on behalf of a disabled BOTOX® victim in state court in Oklahoma City (May 2010). The case was affirmed on appeal.
  • Assisting in obtaining settlement during trial of wrongful death case against the manufacturer of BOTOX®.
  • Assisting in a federal court case where a father and son were injured at a restaurant due to an automobile collision. The case resulted in settlement on the eve of trial.
  • Assisting in wrongful death case against the Ford Motor Company brought on behalf of family members of the deceased. The case resulted in settlement.
  • Participating on a team of the first U.S. attorneys to file and successfully prosecute failure-to-warn claims against the manufacturer of the ORTHO EVRA® birth control patch.

Professional Liability Litigation

  • Assisting in numerous cases defending national and local law firms in malpractice and breach of fiduciary duty actions.
  • Assisting in case brought against attorney involving allegations of theft and breach of fiduciary duty. 
  • Assisting in counseling law firms and attorneys regarding standard of care and potential conflicts of interest. 
  • Extensive experience researching and briefing issues involving attorney and law firm standard of care, conflicts of interest, rules of professional conduct, and the laws governing lawyers.

General Litigation 

  • Selecting jury and assisting in obtaining a favorable defense verdict in business dispute case that involved allegations of fraud. Case was tried in Travis County District Court.
  • Defending individual sued by life insurance company for alleged wrongful distribution of funds.
  • As second chair, successfully represented applicant in contested case hearing before the Texas Commission on Environmental Quality.
  • Coordinating and managing complex discovery in overlapping litigation spanning multiple jurisdictions.
  • Extensive experience with expert witnesses including drafting and defending motions to exclude, taking and defending expert depositions, and preparing experts for trial.
